Jason A. Murphy

Jason Murphy has been with Schmeiser, Olsen & Watts for over 15 years, earning the trust of in-house patent counsel and corporate legal departments all over the world.   Jason’s core practice is patent prosecution and portfolio development for multinational corporations and publicly traded U.S. companies.  He also caters to small business and individual inventors to round out his practice.

Foreign law firms retain Jason for securing patent rights in the U.S. on behalf of their clients.  He has developed strong relationships with law firms in China, Europe, Korea, Japan, Canada, Mexico, Australia, India, and the Middle East.  With his global connections, he effectively executes his domestic clients’ foreign patent filing strategy.

In 2023, Jason led the expansion of Schmeiser, Olsen & Watts into Raleigh, NC, where he intends on contributing to Raleigh’s well-respected and growing innovation ecosystem.  Raleigh is the home to Research Triangle Park (RTP) and the beneficiary of many large-scale investments by some of the largest companies in the world.

He currently lives in the Raleigh area with his family, experiencing the joys of raising a child.



Jason specializes in computer-based hardware and software technologies, cloud computing, artificial intelligence, wind turbines, renewable energy systems, telecommunications, compressor technology, biotech equipment used for cellular and biomolecular processing, analytical chemistry instrumentation, thermal analysis hardware and software, power generation systems, medical devices, control systems, blockchain, retail solutions, automated systems and assemblies, consumer appliances, and medical facility infrastructure solutions.

Since joining Schmeiser, Olsen & Watts in 2008, Jason has drafted and prosecuted well over a thousand patent applications, including key patents that were pivotal to a successful M&A valued in the hundreds of millions of dollars.

He served as lead counsel and backup counsel in several Inter Partes Review (IPR) proceedings, and has also handled multiple post-grant procedures in the USPTO, including both ex parte and inter partes reexamination and reissue applications for both foreign and domestic clients.

Clients count on Jason to prepare infringement and validity opinions, freedom-to-operate opinions, and other due diligence actions involved with patent infringement lawsuits and defense strategies.

In addition to his extensive experience in patent preparation, Jason’s practice includes managing IP portfolios, IP counseling, developing IP strategies for start-ups and established companies, and drafting and negotiating license agreements that have involved millions of dollars.

Furthermore, Jason better serves his clients by bringing his knowledge of trademark law to his practice, advising clients about brand protection strategies, conducting trademark searches, and prosecuting numerous trademark applications for a variety of clients.

Jason graduated from Albany Law School, earning his Juris Doctor in conjunction with completing a Concentration in Intellectual Property with Honors, and received his undergraduate degree in Civil Engineering from the University of Wisconsin-Milwaukee College of Engineering and Applied Sciences. He is admitted to practice in North Carolina and New York and before the U.S. Patent & Trademark Office.

Jason was an Adjunct Professor at Albany Law School, teaching Intellectual Property in Business Organizations from 2015 until he moved to North Carolina in 2023.

While at Albany Law School, Mr. Murphy worked at the Health Law Clinic, representing low-income clients pro bono for all health law issues including insurance coverage. Additionally, Mr. Murphy is a member of the American Intellectual Property Law Association.
