PROFESSIONAL EXPERIENCE

Jason Murphy, a registered patent attorney in Albany NY and partner at Schmeiser, Olsen & Watts, concentrates his practice on patent prosecution and portfolio development strategies for some of the largest companies in the world.  He specializes in patent preparation and prosecution in a wide range of technology areas,  including computer-based hardware and software technologies, telecommunications, analytical chemistry instrumentation, thermal analysis hardware and software, clean energy, power generation systems, medical devices, control systems, blockchain, retail solutions, automated systems and assemblies, consumer appliances, and medical procedures and devices.  Jason interfaces with associates of foreign law firms around the world on a daily basis to effectively manage outgoing patents from domestic clients and carefully handle prosecution of patents coming into the U.S.  He has developed strong relationships with law firms in China, Europe, Korea, Japan, Canada, Mexico, Australia, India, and the Middle East.

Since joining the Albany NY office of Schmeiser, Olsen & Watts in 2008, Jason has drafted and prosecuted hundreds of patent applications, including key patents that were pivotal to a successful M&A valued in the hundreds of millions of dollars. He served as lead counsel and backup counsel in several Inter Partes Review (IPR) proceedings, and has also handled multiple post-grant procedures in the USPTO, including both ex parte and inter partes reexamination and reissue applications for both foreign and domestic clients. In cooperation with the firm’s robust IP litigation group, Jason has prepared a number of infringement and validity opinions, freedom-to-operate opinions, and other due diligence actions involved with patent infringement lawsuits and defense strategies.

In addition to his extensive experience in patent preparation and drafting, Jason’s practice includes managing IP portfolios, IP counseling, developing IP strategies for start-ups and established companies, and drafting and negotiating license agreements that have involved millions of dollars. Furthermore, Jason better serves his clients by bringing his knowledge of trademark law to his practice, having advised clients about brand protection strategies, conducted trademark searches, and prosecuted numerous trademark applications for a variety of clients.

Jason graduated from Albany Law School, earning his Juris Doctor in conjunction with completing a Concentration in Intellectual Property with Honors, and received his undergraduate degree in Civil Engineering from the University of Wisconsin-Milwaukee College of Engineering and Applied Sciences. He is admitted to practice in New York and before the U.S. Patent & Trademark Office.

Jason is an Adjunct Professor at Albany Law School, teaching Intellectual Property in Business Organization since 2015.

While at Albany Law School, Mr. Murphy worked at the Health Law Clinic, representing low-income clients pro bono for all health law issues including insurance coverage. Additionally, Mr. Murphy is a member of the American Intellectual Property Law Association.
